Towards a new regulatory framework for GM crops in the European Union - Scientific, ethical, social and legal issues and the challenges ahead


Aware of the significant potential of nascent biotechnologies, the European Economic Community (the predecessor to the European Union) was one of the first regions in the world to develop a regulatory framework for them. Back in the 1980s, the objective of Community member countries was to strengthen the standards of consensus and collaboration, and of environmental and health safety, as well as to promote an industrial sector of enormous potential. In spite of all effort, towards the end of the 1990s it was a widely accepted fact that a number of political and economic factors were blocking the development of biotechnology in Europe. From that crisis emerged what in some aspects is probably the most comprehensive and rigorous body of regulations for biotechnology in the world today. However, the very high technical level of those regulations did not prevent a new crisis which EU institutions aim to solve with a new regulatory framework. Thus, since March 2015, the way towards the third regulatory framework for Biotechnology in the EU has been open. Will this third regulatory framework finally offer sufficient guarantees to allow a healthy and sustainable development of biotechnology in the EU? What do we need to do so that ‘third time is lucky’? In this work, a group of European and non-European experts, from different disciplines and approaches, discuss the past and the present, as well as the various possible futures, of Genetically Modified Crops in the EU.

Resumo

A inovação é fundamental para o desenvolvimento de qualquer empresa. No setor de alimentos não é diferente, e cada vez mais os consumidores desejam consumir novos produtos que consigam aliar sabor, nutrição, qualidade e segurança. O setor de regulação sanitária é responsável por determinar os padrões de qualidade e segurança para novos produtos, portanto, todo o processo de inovação para a indústria de alimentos deve seguir os fluxos de registro estabelecidos por este setor para ser disponibilizado aos consumidores. No Brasil a regulação sanitária de alimentos é realizada pela ANVISA e pelo MAPA, cada um destes órgãos possui legislação própria para o registro de novas tecnologias. O objetivo deste trabalho foi abordar o fluxo de registro de novas tecnologias para alimentos de origem animal recentemente publicado pelo MAPA, e o fluxo americano utilizado pelo FSIS/USDA e elencar os aspectos que favorecem o processo de inovação destas legislações. A metodologia foi baseada no estudo dos documentos e legislações disponibilizados pelos órgãos de regulação no Brasil e EUA. Observou-se que a nova legislação brasileira para o registro de inovações no setor de alimentos de origem animal se espelha no fluxo de processo utilizado pelas agências americanas. O “termo de não objeção” permite a utilização destas tecnologias por outras empresas, dentro das condições da instrução normativa. Este fato pode estimular o uso de novas técnicas viabilizando a novação nas indústrias de alimentos. A regulamentação do MAPA é mais moderna e também estimula a abordagem da tríplice hélice.

Geographical Indications: a first assessment of the impact on rural development in Italian NUTS3 regions

Abstract

Geographical indications (GIs) are a 25 years old European policy instrument which have, among its objectives, to foster rural development. In this respect, very few studies quantitatively investigate to what extent this policy is effective. Literature is in fact mainly focused on specific GIs, studied through case studies, trying to identify which factors are responsible for the success or failure of specific initiatives. The aim of the present study is instead to quantify the impact of such policy instrument on a single indicator of rural development: agricultural value added. In order to assess the impact we firstly built an index measuring the number of GI schemes implemented at NUTS3 level in the Italian regions. Then, following a difference-in-difference evaluation strategy and relying on an explicit theoretical model, a fixed effect estimator was implemented. The choice of the model, as well as the variables to be considered, is specified using a directed acyclic graph. Results show that an overall positive effect of GI protection on agricultural value added could be identified in Italy, thus providing evidence of a positive impact of the European policy on rural development.
